Law Practice

Catharine Herb-Kelly QC practices civil and administrative litigation.  She handles matters involving professional regulation and discipline, especially in the health care sector, professional negligence, privacy and freedom of information, institutional liability and adult guardianship.  She has appeared before numerous administrative tribunals and all levels of court within British Columbia.  She was admitted to the Bar of British Columbia in 1978.

Catharine’s practice includes medical malpractice defence litigation, and considerable experience appearing before administrative tribunals.  Her professional regulatory experience is broad in scope.  She has spent many hours drafting regulatory bylaws, advising on freedom of information and privacy legislation and other governance issues, has obtained injunctions in respect of unauthorized practice, and considered many issues of statutory interpretation.  In addition she frequently gives training sessions on the application of regulatory legislation, how to investigate offences, how to handle discipline offences and the like.  She also acts as independent counsel to tribunals.

Professional and Community Activities

Catharine has been actively involved in professional and community activities during her career.  She is a Past President of the Vancouver Bar Association and served as Chair of the BC branch of the Canadian Bar Association’s Health Law Section.  She also served on the executive committee of the Medical Legal Society for many years, as well as the Benchers’ Education and Credentials Committees.

As to community involvement, she served as a director of Planned Lifetime Advocacy Network and the Community Legal Assistance Society for 8 years, and completed 8 years as a director and vice president of the Arts Club Theatre Society, and the Arts Club Theatre Foundation.  She is currently serving on the Council of Governors of the Arts Club.

Personal Background

Catharine was born in Vancouver BC and graduated from the Faculty of Law at UBC in 1977.  She practiced as crown counsel in the Vancouver office following articles and then joined Guild Yule & Company where she became a partner in 1984.  She left Guild Yule in 2003 to establish her own practice and joined Gourlay Spencer Wade in 2009 as associate counsel.

Catharine’s interests include travel, videography, theatre, golf and pilates.
